Ex-judge exposes traffic light asylum hoax

The former highest judge in the country is taking stock of the federal government’s asylum policy!

Hans-Jürgen Papier (80), a retired supreme constitutional judge, accuses the traffic light coalition of not using legal means to reject migrants! The justification for this exists — only the political will is missing, he says in an interview with Welt am Sonntag.

Papier had declared in his book Die Warnung [“The Warning”] back in 2019 that, from a legal perspective, the refugee crisis was “a declaration of bankruptcy of the constitutional state”. “I could publish that sentence again today,” says Papier in the Welt am Sontag interview. Unfortunately, almost nothing has changed.

The former constitutional judge was tough: “It has actually been known for almost ten years that the asylum law system both in the European Union and at the national level — at least the way it is handled — is unsuitable for dealing with the crisis.” Nevertheless, nothing had been done. Migration is still the central problem of the states of the European Union, and especially Germany.

“Repressed, concealed, pushed aside”

The population was always largely aware of this, says the constitutional lawyer. And adds: “But politicians have suppressed the problem for a long time, kept it quiet and simply kicked the can down the road. And that is now taking its revenge.” Only now, under the renewed pressure of the numbers and the influx of extremist parties, have people finally, finally woken up again.

Highly explosive: According to Federal Interior Minister Nancy Faeser (53, SPD), it is not possible to send asylum seekers back to Austria, the Czech Republic or Poland. An asylum application must therefore always be examined in Germany. Papier thinks this is WRONG!

In Faeser’s opinion, every man and woman in the world should be allowed to enter the Federal Republic in order to apply for asylum. “The associated temporary right of residence often turns into a stay of incalculable duration, either in fact or for legal reasons,” says Papier.

In many cases it is a matter of “illegal, unlawful migration for which the right to asylum serves as a door-opener for a purpose that is not intended”. The mechanism that requires everyone to be allowed to enter because they want to apply for asylum or a follow-up application in Germany is not mandatory under EU law, either.

According to Papier, Germany can turn back migrants at the border. “Section 18 paragraph 2 of the Asylum Act of the Federal Republic of Germany states that people must be refused entry if they come from a safe third country. This includes all EU states and Switzerland. So Germany is surrounded by safe third countries without exception.”

  1. Mr. Papier is right. But the reigning coalition does not uphold the existing law. Like Ms Merkel did.
    There should be as soon as possible a new government and before that a new election.

  2. Unfortunately we have the same problem here in the states under the current administration. I am from Germany and my heart cries for what is happening over there. My beautiful home country is going to hell. I had thought about spending my retirement years in Germany but not the way it is now.
