A New Islam Law in Austria?

Islam has been an official state-recognized religion in Austria since 1912, when its status was legally established by the Austro-Hungarian Empire. However, although the current law requires that officially-recognized religions not contradict Austrian law, the state has never systematically examined the content of Islamic teachings in order to discover whether Islam is compliant.

All that may be about to change. A revision of the Islamic law has been proposed, and has a good possibility of being passed. Under the terms of the new law, the Koran and the Sunna will be officially translated into German, and the contents scrutinized by the state to determine whether they are in fact compatible with Austrian law.

Vlad Tepes interviewed Elisabeth Sabaditsch-Wolff earlier today about these momentous developments:

A Victory in Knoxville

Last winter, the Council for American-Islamic Relations (CAIR) managed to apply enough pressure to a Tennessee school district to shut down an after-hours presentation on sharia at a school facility. The presenters at the event in question would have been Dr. Bill French — better known to Gates of Vienna readers by his nom de plume Bill Warner — and one of his colleagues.

Freedom X, a non-profit legal organization that protects conservative and religious freedom of expression, took up the case and sued the school district. I’m happy to report that school officials recognized they could not possibly win, and settled with the plaintiffs. They have agreed to revise the school’s policies — which essentially gave aggressive complainers a heckler’s veto over their events — and will pay the plaintiffs’ legal costs.

Freedom X lawsuit forces Tennessee school district to allow politically incorrect after-school speech critical of Sharia

KNOXVILLE — After canceling a town hall meeting at the request of Muslim activists, a Tennessee school district and two school officials have settled a lawsuit over the public’s right to voice concerns about the growing acceptance of Islamic law, known as Sharia law, spreading through American communities. The settlement was finalized Wednesday evening when the district approved a policy [pdf] barring school officials from selectively determining which subjects can be discussed by members of the public using school facilities.

In February, the Knoxville chapter of ACT! for America, an organization opposed to Sharia, planned an after-hours town hall meeting at a local area high school. Dr. Bill French, an expert on Islam, and Matt Bonner of Crescent Project, a Christian ministry reaching out to Muslims with the Gospel, were scheduled to speak at the event.

John Peach, president of the Knoxville chapter of ACT! for America, and French sued the school district in U.S. District Court on August 4, 2014, for violating their First Amendment right of free speech and their Fourteenth Amendment rights of equal protection and due process. The county agreed to settle the lawsuit [Peach vs. Knox County Schools, pdf] just 21 days after it was filed. In addition to revising its facility use policy, the county will pay attorneys’ fees and costs.

The new facility use policy states in part that “[a]pproval for use of school buildings and property will not be withheld based upon the content of the message or viewpoint of the applicant.”

“This is a victory for free speech,” said Bill Becker, president of Freedom X, a non-profit legal organization fighting discrimination against conservatives and Christians. “Sharia is incompatible with our constitutional and legal protections. That was the message Knox County school officials tried to censor. It is unfortunate we have to educate the educators about our freedoms, but we are thankful that Knox county attorneys recognized litigation would have been futile for the district.”

Gates of Vienna News Feed 10/2/2014

The Islamic State called on its supporters to utilize social media to find the addresses of the families of American military personnel, go to their homes, and slaughter them. The Army has warned soldiers to take precautions to protect their families, and to keep personal data off public sites. Fortunately the situation, although worrisome, has nothing to do with Islam.

In other news, authorities in the Islamic Republic of Iran hanged a former professor for committing heresy. The unfortunate man made the mistake of telling his students that the prophet Jonah could not possibly have emerged from the belly of the whale. The incident had nothing to do with Islam.

Geert Wilders to the Dutch Government: Wake Up!

Below is the English translation of a speech given today in the Dutch parliament by Geert Wilders, the leader of the PVV. The speech was part of a parliamentary debate about the military mission to fight ISIS in Iraq.

Madam Speaker,

The Islamic State is an Islamic cancer. It is a poisonous snake based on the Quran and the life of Muhammad, a criminal who 14 centuries ago went, murdering and decapitating, from Medina to Mecca. His self-appointed successor Caliph Baghdadi is now at the gates of Baghdad and Damascus. He has followers all over the world, including in our country, our cities and streets. Again, people are beheaded according to the Koranic commands such as Sura 47 verse 4: “When ye meet the unbelievers, smite at their necks and when ye have caused a bloodbath among them bind a bond firmly on them.” Even moderate Muslims cannot escape violence because, according to the Koran and the Sharia, they are apostates.

All the gullible minds who say that the Islamic State has nothing to do with Islam are committing a serious politically correct error, whether they are Obama, Cameron, Rutte or Samsom.

We are at war. War has been declared against the free West. Our freedom, our culture, the future of our country and our children are at stake. We must strike back hard, in the Netherlands, in the rest of the West and also in Iraq and Syria. Hence, my party supports the Government’s decision to deploy Dutch F16s against the Islamic state. We say: Let us bomb them!

But we have no understanding for the fact that we are only going to bomb in Iraq and not in Syria. Is it OK for the Government that people are beheaded, women raped and genocide committed in Syria because a mandate under international law is missing? What a cowardice. The government says it understands the United States when they bomb the Islamic State in Syria, but it does not participate itself. Understanding, but no participation, What a cowardly half-heartedness.

What Sort of Mosque is the Islamic Society of Greater Oklahoma City?

Alton Alexander Nolen, a.k.a. Jah’Keem Yisrael, is alleged to have beheaded a former co-worker at a food distribution center in Oklahoma. Before engaging in activities that have nothing to do with Islam, Mr. Nolen attended the mosque of the Islamic Society of Greater Oklahoma City. Media reports in the wake of the incident quoted various sources who asserted that the ISGOC mosque did not promote any extremist ideologies or teach violent jihad to its members.

On Tuesday Robert Spencer of Jihad Watch interviewed a former member of the ISGOC mosque who emphatically disagrees with the rosy picture painted by the media. He is a native Oklahoman who converted to Islam and attended the same mosque as Mr. Nolen. He eventually became disillusioned with Islamic teaching and became an apostate.

The first American case of Ebola exposed several schoolchildren in Dallas to possible infection with the disease. Although the authorities stress that there is no evidence that any of them have actually been infected, a number of parents have pulled their children from those schools.

Do Muslims in the OSCE Region Support the Islamic State?

First of all, Pax Europa supports the statement made by Christian Solidarity Worldwide.

BPE is concerned about the widespread support for ISIS in Islamic communities throughout Europe and elsewhere. Fighters by the thousands have traveled to Syria and Iraq, some of whom return to our countries, their fanaticism, and loyalty to the Caliphate and not least their skills in weapons and explosives which could wreak havoc in the OSCE region. Barring these warriors from traveling to war areas of the Islamic State is one option; however, Pax Europa believes it is better to prevent them from returning, especially since they have taken up arms in another entity other than their country of nationality. Freedom of Religion should not mean the right to wage war against unbelievers, or Kuffar.

Also worrisome is the number of like-minded individuals who did not leave, and the network that must be assumed to exist within the OSCE region. This security risk must be addressed by participating States and the OSCE.

Another aspect deserving our attention is the legitimacy of the Islamic State. Denouncing it as “International Strong Ignorance Syndrome” is all very well, but it does not address the heart of the matter. If it can be shown that the Islamic State has nothing to do with Islam, we can look forward to their barbaric acts being denounced as the criminal acts they are, from all major Islamic authorities outside the Islamic State, in the OSCE region.

Sharia is an Abuse of Human Rights

As a preliminary remark I’d like to declare that the International Civil Liberties alliance supports the recommendations of Christian Solidarity Worldwide NGO report.

Promoting sharia is not a religious freedom, it’s an abuse of rights.

Sharia is an ideology which defines itself as a coherent block from which no one can subtract anything.

Sharia isn’t a system of moral principles from which one can pick and choose following a personal interpretation.

Sharia contains six fundamental elements:

  • The “Ummah” concept which defines a human group enforcing sharia and trying to follow its rules.
  • The Islamic state (caliphate) concept as the only legitimate model of political and social organization.
  • Compulsory regulations commanding all aspects of social behaviour.
  • Discriminatory regulations against women and non-Muslims.
  • The concept of “faith-based legitimate violence”.
  • And ultimately the concept of “permanent war” waged by the Ummah against all those who do not submit to sharia.

Sharia is an ideology like Nazism and communism, with the particularity of being simultaneously a theocratic and a totalitarian system.

All individuals or organizations promoting sharia rule or a doctrine containing sharia engage in activities of a political nature. Categorizing a group of sharia proponents as being “cultural” or “religious” is deceptive and inaccurate. The only true way to categorize such group is : “theocrato-totalitarian”.

No country truly committed to civil right protection can allow such groups to freely operate on their territory, because they are a real threat to human rights and democratic institutions.

ICLA recommends:

That OSCE encourage participating states adopt legislation empowering participating states to re-categorize as “political and anti-democratic” every organization which regularly promotes sharia in its activities. And especially so in all educational activities targeting children.

That ODIHR, during the process of elaborating laws, remain vigilant about the need for a legal framework scrupulously respecting the freedom of belief and of religion of other groups and individuals.

The first case of Ebola brought to the United States by airliner was confirmed today. A man infected with the virus flew from Liberia to Texas ten days ago to visit relatives, before he had any symptoms. He sought medical attention four days ago, after the disease manifested itself.

In other news, Amnesty International says the EU must commit more naval and air resources to the rescue of illegal migrants and make sure that their passage across the Mediterranean is safe.

BPE is gravely concerned about the threat emanating from the Islamic State (IS), which, according to a professor for Islamic pedagogy at the University of Vienna, “from a theological perspective, [is] 100% legitimate”. IS has led a number of Austrian men and women to travel to Syria and Iraq in order to fight alongside IS, leading the Austrian government to introduce even stricter laws with regard to freedom of speech.

There are currently efforts to relaunch the Law on Islam. This is laudable, especially since the draft includes a demand for the disclosure of Islamic teachings and beliefs in the German language (Koran and Hadith).
We support the efforts of the Austrian Minister of Foreign Affairs, who has already called for the publication of an official German translation of the Koran.

Recommendation to the Austrian Delegation

  • BPE recommends that Austria take seriously its OSCE commitments with respect to implementing the Law on Islam in Austria.
  • BPE recommends that Austria actively obtain written affirmations from Islamic organizations that they do not currently, and will not in the future, seek to introduce Sharia law in the land.

The question “What is the role of inter religious and inter-community dialogue in addressing tolerance and non-discrimination and what can governments do to encourage and facilitate it?” raises concerns.

Stated in the negative, at what point does government coercion to engage in inter-religious dialogue run counter to the religious interests of those undertaking it who in theory are speaking on behalf of their faith community? This is especially true when discussions disproportionately serve the interest of one religion to the detriment of the others.

A parallel concern is that interfaith dialogue today tends to follows relativist rules that subordinate faith interests to diversity concerns through narratives designed to suppress reason. In such an environment, interfaith “partners” all to commonly become caught up in the fraternal need to bond over the need to protect equities.

Mr moderator, ladies and gentlemen, thank you.

We in the International Civil Liberties Alliance agree that hatred can be dangerous and lead to serious crimes. As mentioned in the opening speech, today is the anniversary of the mass murder of many Jews at the Auschwitz death camp, undoubtedly a crime motivated by hatred propagated by Nazi Germany. However when terms such as hate crimes, and speech are poorly defined, there is a risk of malicious prosecutions and even cover-ups to shut down debate inconvenient for certain groups.

Lately, we have seen many examples of this — to cite just two, in Poland, the owner of a webpage, Damian Kowalski, was investigated by police over a supposed hate crime. His webpage, ndie.pl or “No to Islamisation of Europe” reported on cases of Islamic extremism in Western countries, often simply translating reports into Polish from mainstream Western media. The police justified their investigation, and confiscation of computer equipment, by saying the accused “incited to hatred of believers of Islam”, did not elaborate on where he had done this. Meanwhile in the UK city of Rotherham, a report found that 1400 underage girls were sexually abused and groomed for prostitution by gangs that were (more or less) unanimously acknowledged to be mainly Pakistani in origin. Such abuses were found to be covered up by police and child protect services, partly as the ethnic origin of gangs made this a sensitive issue. In other words — the need not to be even suspected of inciting hatred took precedence over physical protection of young vulnerable girls.

Protection of Free Expression vs. “Prior Restraint”

From the OSCE published document “Freedom of Expression and Hate Speech,” from the Mission to Skopje in December 2013, the following statement is made[1]:

“Freedom of opinion is an absolute civil right, meaning no-one can jeopardize or limit human thinking, whereas freedom of expression is treated as a political right.”

What is thought if it cannot be expressed? When the right to free expression is made conditional, a mockery is made of the “absolute civil right” of freedom of opinion. An artificial distinction designed to suppress expression is created — and through it, so is thought. We cannot allow narratives the power to reduce rights to meaninglessness.

Just outside this room, we then find OSCE publications with Orwellian titles like:

  • Handbook on Monitoring Freedom of Peaceful Assembly, OSCE, ODIHR
  • Online Media Self-Regulation Guidebook – OSCE Representative on Freedom of the Media
  • Guidelines on Freedom of Peaceful Assembly, 2nd – OSCE

It is with great concern that these titles are associated with discussions on hate speech where “hate speech” lacks a coherent — reasonably concrete — definition.

When hate crimes lack definition, the state is given a powerful hand against its citizens (and dissent) to make arbitrary decisions as to what constitutes hate that will end up being what the state says it is. The powerful get to impose their will on weak.

Some of my European friends noted to me recently that Europe does not have a developed doctrine on the protection of free expression comparable to the American doctrine of “Prior Restraint” (or formal censorship before publication). From Black’s Law Dictionary:

“The legal doctrine of prior restraint (or formal censorship before publication) is probably the oldest form of press control. Certainly it is one of the most efficient, since one censor, working in the watershed, can create a drought of information and ideas long before they reach the fertile plane of people’s minds. In the United States, the doctrine of prior restraint has been firmly opposed by the First Amendment, and by the Supreme Court. But the philosophy behind that doctrine lives zestfully on, and shows no signs of infirmities of age.” Black’s Law Dictionary, 9th, Bryan A. Garner, Editor in Chief, West Publishing (Thomson Reuters), St. Paul, 1314; (citing David G. Clark & Earl R. Hutchinson, Mass Media and the Law 11, 1970)

This doctrine seems especially alive and well in this forum.

Recommendation:

MISSION EUROPA recommends that heightened awareness to legal theories like “Prior Restraint” be developed and considered when assessing concepts that concern state action — including non-state actors acting under color of authority — when considering activities involving free expression.

It also recommends that distinctions between thought and expressions be considered suspect deserving strict scrutiny.
