Thuringian Office for the Protection of the Constitution will in future work without parliamentary control
The Thuringian Office for the Protection of the Constitution [TfV] headed by Stephan Kramer, now has no parliamentary control. All previous members of the control body have left the state parliament, and a new election is not possible due to the political situation. This means that the state’s constitution is being violated. The Parliamentary Control Committee, which was supposed to monitor the Office for the Protection of the Constitution, is now unable to act because all previous members were not re-elected to the state parliament. A new election of members would require a two-thirds majority in parliament. This majority could only be achieved through cooperation between the CDU, the Linke Party, the SPD and the BSW with the AfD, which holds 36.4% of the seats in the state parliament. However, such cooperation is categorically rejected by the other parties.
Danger of uncontrolled surveillance
According to the Thuringian constitution, parliament is obliged to monitor the TfV to prevent it from becoming a kind of secret police that introduces illegal surveillance practices. Normally, five MPs are supposed to oversee the activities of the TfV, but recently there were only four, as the AfD was excluded from the body by the other parties. Previous members of the control committee included Dorothea Marx (SPD), Raymond Walk and Jörg Kellner (both CDU) and Dirk Bergner (FDP). None of them were re-elected to the state parliament.
The nationwide pressure to keep the AfD away from the control of the TfV is considerable. Thomas Haldenwang (CDU), President of the TfV, warned that Thuringia could be excluded from the TfV if the AfD were to be included in the control body.
This could make Thuringia the first federal state in which the TfV operates without any parliamentary control. Stephan Kramer, who is considered a particularly determined opponent of right-wing movements, has classified the AfD as “combative and aggressive” and “proven right-wing extremist”. Interestingly, Kramer is the only head of the TfV who does not meet the formal requirements, as he is not qualified to hold the office of judge. Nevertheless, he was appointed to this office by the red-red-green state government.
