Gates of Vienna News Feed 10/10/2021

Early this morning multiple shooters opened fire in a bar in downtown St. Paul, Minnesota, killing one woman and wounding 14 other people. Police later arrested three people in connection with the incident, who will be taken into custody and charged when they are released from the hospital.

In other news, after 106 days, Sydney has finally lifted its lockdown. Citizens will be able to regain their freedoms, but only if they have been fully “vaccinated” against COVID-19.

Bitcoin stands at $55,000 today, as of writing these lines. This means it’s about 90% up since the beginning of 2021.

While that’s impressive on its own, what’s even more notable is BTC’s performance compared to other well-known investment tools such as some of the most popular stock market indexes, the world’s largest companies, and precious metals like gold and silver.

Caravan Protests Attempt to Remove Anti-Biden Flag

Angry by officials’ efforts to have a “F*** Biden” sign removed from a local resident’s property, a caravan drove through parts of Kokomo and in front of Mayor Tyler Moore’s house in protest Saturday.

The caravan, organized by Evansville politician Gabe Whitley, was a dozen vehicles long. Participants also drove past the house belonging to Greg Sheline, executive director of the Kokomo-Howard County Plan Commission, in protest of the commission and city’s efforts to fine Brandon Adams if he doesn’t remove the flag from his property.

“The government has no right to fine and intimidate and send government officials to their houses and tell them they cannot exercise their First Amendment, God-given right,” Whitley said.

The caravan was in support of Adams’ lawsuit against the city and county regarding his “F*** Biden and f*** you for voting for him!” flag. Adams placed the flag outside his house as a response to President Joe Biden’s directive to the Occupational Safety and Health Administration to write a rule requiring employers with at least 100 workers to force employees to get the COVID-19 vaccine or produce weekly test results showing they are virus free.

Gradually, And Then Suddenly

We are now at the same apex that Venezuela achieved with the rise of Hugo Chavez — it is just that our Hugo is a multi-headed communist hydra instead of one titular leader. It took the Chavistas about 40 years to bring their country to communism and only about five until they were eating zoo animals and rats.

Gradually and then suddenly.

People may think this is all happening suddenly to America — but the fact is this process has been ongoing for most of my adult life. A nudge to the left here and there, but the nudges are constant and never back to the right. Biden is the “suddenly” part of the “gradually”.

Merrick Garland’s Problems With His Son-in Law Just Got Worse

Authored by Andrew Widburg via AmericanThinker.com

Over the last few months, as COVID brought classrooms into American homes, parents learned that their children are being taught Critical Race Theory (i.e., Whites are evil; Blacks are pathetic) and magical thinking about gender, as well as being forced to wear masks that don’t protect against disease, but do interfere with children’s health, learning, and socialization. Their vigorous complaints saw the National School Board Association suggest they’re “domestic terrorists” and Merrick Garland answer the call. We learned, too, that Merrick Garland’s son-in-law, through his company, Panorama Education, sells CRT materials to public schools. And yesterday, it turned out that Panorama is also spreading material calling Trump and his supporters “white supremacists.”

Newsom Imposes Vaccine Mandate for All California Kids But His Own Tween Daughter is Still Unvaccinated

California’s incoming COVID-19 vaccine mandates bring Gov. Gavin Newsom’s own upheld standards into question on the topic. The governor pivoted back to the pandemic after fighting off challengers in the state’s recent recall election.

It was at the beginning of October that Newsom announced mandatory vaccines for all K-12 students in the state. Both public and private school kids will be required to get it once the FDA gives full approval to those age groups.

According to the Los Angeles Times, it’s these sorts of legal “caveats” that are being debated currently. For the Pfizer-BioNTech jab in particular, FDA approval starts at 16 and older. An emergency authorization is in place for children ages 12 to 15.

Police: Shooting in Busy St. Paul Bar Kills 1, Injures at Least 14

Police said while the investigation is in its early stages, they believe multiple shooters were involved.

ST PAUL, Minn. — An early Sunday morning shooting in a busy St. Paul bar left a young woman dead and at least 14 people injured.

Multiple 911 callers alerted police to the shooting at about 12:15 a.m. Sunday, the St. Paul Police Department said in a news release. It happened at the Seventh Street Truck Park, a bar and food hall near Xcel Energy Center in downtown St. Paul.

Officers found a “chaotic” scene with 15 people who had been shot. St. Paul police spokesperson Steve Linders said some were lying inside the bar, with others lying on the street and the sidewalk.

One of them, a woman in her 20s, was pronounced dead at the scene. Her identity and cause of death will be released at a later date after an autopsy.

Police said 14 other people were taken to local hospitals, and all are expected to survive. Bystanders helped officers give aid as medics made their way to the area.

Based on preliminary information, investigators believe there were multiple shooters. No motive has been determined…

The Art Institute of Chicago Fires All 122 of Its (Unpaid and Volunteer) Docents Because They Aren’t Sufficiently “Diverse”

This is a story that, for obvious reasons, has gotten almost no airplay in Chicago, and none nationally, with no reporting in the major media. So let me tell you about it.

The Art Institute of Chicago (AIC), one of the world’s finest art museums, harbors (or rather, harbored) 122 highly skilled docents, 82 active ones and 40 “school group greeters.” All are volunteers and are all unpaid. Their job is to act as guides to the Museum’s collection of 300,000 works, which they explain to both adults and schoolchildren. I’ve seen them in action at the Museum, and they’re terrific.

Despite the lack of remuneration—they do this to be helpful and because they love art—their training to be docents is extremely rigorous. First, they have to have two training sessions per week for eighteen months, and then “five years of continual research and writing to meet the criteria of 13 museum content areas” (quote from the docents’ letter to the Director of the AIC). On top of that, there’s monthly and biweekly training on new exhibits. Then there are the tours themselves, with a docent giving up to two one-hour tours per day for 18 weeks of the year and a minimum of 24 one-hour tours with adults/families. Their average length of service: 15 years. There are other requirements listed by the Docents Council in the ChicagoNow column below (first screenshot).

Many of the volunteers—though not all—are older white women, who have the time and resources to devote so much free labor to the Museum. But the demographics of that group weren’t appealing to the AIC, and so, in late September, the AIC fired all of them, saying they’d be replaced by smaller number of hired workers who will be paid $25 an hour. That group will surely meet the envisioned diversity goals.

When the West ‘Manfully Resisted’ Islam: The Battle of Tours

by Raymond Ibrahim

Today in history, on October 10, 732, one of world history’s most decisive battles saved Europe from becoming Islamic.

Precisely one hundred years after the death of Islam’s prophet Muhammad in 632 — a century which had seen the conquest of thousands of square miles of formerly Christian lands, including Syria, Egypt, North Africa, and Spain — the scimitar of Islam found itself in the heart of Europe in 732, facing that continent’s chief military power, the Franks.

After the Muslim hordes, which reportedly numbered 80,000 men, had ravaged most of southwestern France, slaughtering and enslaving countless victims, they met and clashed with 30,000 Frankish infantrymen under the leadership of Charles Martel, on October 10, somewhere between Poitiers and Tours. An anonymous medieval Arab chronicler describes the battle as follows:

Near the river Owar [Loire], the two great hosts of the two languages [Arabic and Latin] and the two creeds [Islam and Christianity] were set in array against each other. The hearts of Abd al-Rahman, his captains and his men were filled with wrath and pride, and they were the first to begin to fight. The Muslim horsemen dashed fierce and frequent forward against the battalions of the Franks, who resisted manfully, and many fell dead on either side, until the going down of the sun.

Entirely consisting of wild headlong charges, the Muslim attack proved ineffective, for “the men of the north stood as motionless as a wall, they were like a belt of ice frozen together, and not to be dissolved, as they slew the Arab with the sword. The Austrasians [eastern Franks], vast of limb, and iron of hand, hewed on bravely in the thick of the fight,” writes one chronicler. The Franks refused to break ranks and allow successive horsemen to gallop through the gaps, which Arab cavalry tactics relied on. Instead, they tightened their ranks and, “drawn up in a band around their chief [Charles], the people of the Austrasians carried all before them. Their tireless hands drove their swords down to the breasts [of the foe].”

Military historian Victor Davis Hanson offers a more practical take:…

Syrian and UAE Ministers Discuss Reconstruction

UAE first Gulf nation to resume investment in Damascus

BEIRUT — Syria’s trade and economy minister Muhammad Khalil has met with his UAE counterpart Abdullah bin Tawq al-Marri in Dubai on the sidelines of events linked to Expo2020.

Reports were from the Syrian government news agency SANA, which noted that the ministers had discussed bilateral trade issues.

In 2019, the UAE became the first Arab country to resume investing in Syria after a lengthy absence due to the conflict that began in 2011 and continues in some areas of the country.

Alongside Saudi Arabia, the Abu Dhabi government had initially backed Syrian opposition-in-exile factions.

However, over the years it returned to talking to the government in Damascus under President Bashar al-Assad, who is supported by Iran and Russia.

In December 2018, Abu Dhabi reopened its embassy in Damascus.

Some analysts say that others in the region are likely to follow in its footsteps.

Syrian minister Khalil, SANA reported, illustrated the details of the Syrian investment laws to his UAE counterpart, claiming that they “create an investment climate suitable for the recovery and reconstruction phase” of the country, which has just suffered a decade of war.

The UAE minister reiterated UAE’s interest in providing support for reconstruction in Syria and in so doing “transfer the UAE’s successful experience in the economic sector”.

Bangladesh: Hindu Man Arrested and Family Put Under House Arrest Over Alleged ‘Blasphemous’ Message on Facebook

A glimpse into the future of the West. This is where the Left’s “hate speech” rhetoric is tending. We are very close to this now, far closer than most people realize. What is the next step? This. Remember: Biden pledged to combat “hate speech,” which is any speech that those in power dislike, and a member of his transition team wanted to outlaw desecration of the Qur’an. As the movement for criminalization grows, so will violence directed at transgressors. We are far closer to this than most people think.

India: Muslims Murder Four Non-Muslims in 48 Hours in Jammu and Kashmir

In the past few days, at least four civilians, including two teachers and one chemist, have become victims of targeted killings of non-Muslims by Islamic jihad terrorists in the union territory of Jammu and Kashmir, India. The liberal media houses who had been crying themselves hoarse and secular politicians who have been shedding tears over Internet restrictions in the valley have buried their heads in the sand as jihadis slaughter non-Muslims in Kashmir.

The principal of Government Boys Higher Secondary School, Idgah Satinder Kaur, and another teacher, Deepak Chand, were shot inside the school on Thursday, October 7. The attack took place after two armed terrorists barged into the principal’s office, where a group of teachers were holding a meeting. The terrorists reportedly lined up all the teachers and asked them to produce their identity cards. Their mobile phones were also checked by the terrorists in order to ascertain their identities. Reports also suggest that the terrorists interrogated the teachers, segregated them on the basis of their religion, let the Muslim teachers go, and opened fire at the two non-Muslim teachers at point-blank range. So much for the phony notion that “terrorism has no religion.”

“It’s a Big Day for Our State” — Sydney Lockdown Finally Ends After 106 Days

Not long after controversial New South Wales Premier Gladys Berejiklian stepped down amid a corruption scandal, Sydney residents are breathing a sigh of relief early Monday (local time) as a nearly four-month-long lockdown afflicting Australia’s most populous city has finally been lifted, AFP reports.

For the last 106 days, Sydney’s 5 million residents have been living under lockdown conditions, intended to suppress the hyper-infectious (allegedly) delta variant. The measures became an international joke as cases continued to soar (and are at an all time high currently), and the government mostly stood by their policy directives, despite the fact that Australia has recorded an enviably low number of hospitalizations and deaths.

The Jihadist Genocide of Christians in Nigeria Intensifies

What several international observers have for years characterized as a “pure genocide” of Christians in Nigeria has reached new levels.

Since the Islamic insurgency began in earnest in July 2009 — first at the hands of Boko Haram, an Islamic terrorist organization, and later by the Fulani, who are Muslim herdsmen also radicalized and motivated by jihadist ideology — more than 60,000 Christians have either been murdered or abducted during raids. The abducted Christians have never returned to their homes and their loved ones believe them to be dead. In addition, in the same time frame, approximately 20,000 churches and Christian schools have been torched and destroyed.

He remarked, “Every nation that has survived has had borders that were defensible and clear, and the idea was that they have their own space to inculcate their language or traditions or customs, then enhance their constitution. Without that, it’s just short of a migratory, 5th century A.D. Rome where people come across the Danube River and destroy the nation-state.”

Growth of “identity politics” predicated on ethnicity and race, Hanson warned, would contribute to American collapse if unchecked.

Germany: Muslim Migrant Molests Several Young Women and Threatens Them With a Knife

Why does this keep happening? In France, a Muslim quoted Qur’an while raping his victim. A survivor of a Muslim rape gang in the UK has said that her rapists would quote the Qur’an to her, and believed their actions justified by Islam. Thus it came as no surprise when Muslim migrants in France raped a girl and videoed the rape while praising Allah and invoking the Qur’an. In India, a Muslim gave a Qur’an and a prayer rug to the woman he was holding captive and repeatedly raping. And the victim of an Islamic State jihadi rapist recalled: “He told me that according to Islam he is allowed to rape an unbeliever. He said that by raping me, he is drawing closer to God…He said that raping me is his prayer to God.” In India, a Muslim kidnapped and raped a 14-year-old Hindu girl, and forced her to read the Qur’an and Islamic prayers. In Pakistan, another Christian woman recounted that her rapist was also religious: “He threw me on the bed and started to rape me. He demanded I marry him and convert to Islam. I refused. I am not willing to deny Jesus and he said that if I would not agree he would kill me.” Rapists demanded that another girl’s family turn her over to them, claiming that she had recited the Islamic profession of faith during the rape and thus could not live among infidels.

The Qur’an teaches that Infidel women can be lawfully taken for sexual use (cf. its allowance for a man to take “captives of the right hand,” 4:3, 4:24, 23:1-6, 33:50, 70:30). The Qur’an says: “O Prophet, tell your wives and your daughters and the women of the believers to bring down over themselves of their outer garments. That is more suitable that they will be known and not be abused. And ever is Allah Forgiving and Merciful.” (33:59) The implication there is that if women do not cover themselves adequately with their outer garments, they may be abused, and that such abuse would be justified.

However, anyone who points all this out will be excoriated as a “racist” and an “Islamophobe,” and accordingly ignored.

  1. From one telegram channel.

To international news. Germany will pay pensions to blockade Jews.

Yes, you read that correctly. During the Second World War, Germany led a blockade of the Russian city, and the money will be paid to the Jews. The efforts of the Claims Conference organization for many years have been crowned with success: the German government will pay pensions to the blockade Jews as victims of the Holocaust – 4,500 euros per year per person.

Have you heard anything about the RF government demanding the same payments for the Russians? Do you know why you haven’t heard? Because, in the opinion of our multinational authorities, in the Second World War, the “Soviet people” fought and won, and not the Russian, and accordingly, the Russians did not suffer from the blockade. By the way, where are these Soviet people now? Gone somewhere! Therefore, this question is not worth it to pay someone money. There is no one. In Israel, on the contrary, the power is nationalistic, and therefore the result is the same.

On Echo of Moscow, too, some nationally minded Jews gathered. For example, Liza Lazerson has been running the Internet for several days and explains why in this situation it is correct to pay Jews, and not Russians, although this is just a paramount chutzpah (Jewish arrogance), taking into account that if it were not for the Russians, they would simply not exist physically.

  3. In Memoriam..Anglo-saxon justice A.D 2016..
Polish emigrant Arkadiusz Jozwik living and working in Harlow..England september 2016 ,waiting for his pizza order at local pizza place was beaten to dead by the group of 11 white Brits because hi speeak Polish on his cellphone..
One of the Brits has been sentenced to three and a half years in a young offender institution for the manslaughter of a Polish man, defendant, who was 16 years old at the time of the attack, had denied the manslaughter of Jozwik, 40, but was found guilty by a jury at Chelmsford crown court.

Passing sentence at Chelmsford crown court, Judge Patricia Lynch said the victim “was a perfectly decent, upstanding, well-loved man in his prime” whose death would be felt by his family, all of whom now live in Harlow, for the rest of their lives.

“The case is also a tragic one not only because of Mr Jozwik’s death, but because I now have to sentence a young man who is but 16 years of age, she said…

The court heard the defendant had two previous convictions, one for possessing half a knuckleduster and the other for threatening behaviour, and was on bail for a separate matter at the time of the attack.

Pointing to psychological reports that said the defendant regretted and felt remorse over Jozwik’s death, as well as his difficult background, Lawyer called on the judge to stop short of jailing the boy.

Rosina Cottage QC, prosecuting, read out an impact statement from Jozwik’s brother, who said he had to take two months off work to come to terms with the “unexpected and tragic” death.

In a second impact statement, Jozwik’s mother, Ewa, said: “A year has passed since Arek died but every day I miss him as much. There are moments I don’t want to live any more.”
This is, how much worth life of Slavic Untermensch for dear to speak Polish in public place in England..

    • You are talking [complete untruths] and propagating lies.

The youth who attacked Jozwik was black. He punched Jozwik because Jozwik and his companion, who were both drunk, made racist comments to a group of youths. One of the youths punched the drunken Mr Jozwik, who fell and cracked his head, causing his death.

For these reasons, the youth was convicted of manslaughter, not murder.

As with so many crimes these days in England, both the victim and perpetrator are either foreign or immigrants. You have slandered England and the English with your contemptible lies.

        • You are [mendacious] and [your assertions are untrue].

The facts of the case were reported. At first they were used by the press to slander Brexit, as the implication was that Brexit supporting white men had attacked and killed a Pole for no reason other than that he was a Pole.

It then emerged that the attacker was a black youth who had been racially abused by the Pole. The youth punched him and the Pole fell, hitting his head, and thus died.

For this reason the youth was convicted of manslaughter, not murder. The reason he punched the Pole was that the Pole had racially abused him.

When the British press could not use this event to attack Brexit, they lost interest. They do not like to publicize cases of blacks killing whites. If it had really been a racist attack by Brexit supporters against a Pole we would never have heard the end of it, but the facts did not fit that narrative.

The Pole was the author of his own misfortune by racially abusing black youths, one of whom retaliated. White British people know better than to provoke blacks, who ae prone to violence.

Your comments are a slander on all white British people. You should be ashamed of yourself. I will not comment further on your pathetic lies and untruths.

          • Yeah…yeah…

In Sochi (a resort on the Black Sea), a Shawarma worker (Doner Kebab – as it is called in the west) stabbed a knife in the back of a spaniel, which accidentally ran into the pavilion.

The usual walk of the red spaniel Fedya in the Lazarevsky district almost ended in tragedy. On Sunday, October 10, the curious dog, as usual, walked on the street and looked into the kiosk where shawarma is prepared. Most likely, he was attracted by the smell of food. When the cook saw the dog, without thinking twice he stuck a knife in its back. He says that he was very frightened, although the good-natured Fedya had never aroused fear in anyone before.

    – The man was cutting the meat when the dog ran up. According to him, he is very afraid of four-legged, so he decided to defend himself, – commented in the press service of the Internal Affairs Directorate for Sochi.

After being stabbed, the dumbfounded spaniel began to run down the street, a handle protruding from its back. He did not whine or bark, calmly looked around. Eyewitnesses tried to help the animal, but then the hostess came, who works not far from the scene. She called a car, Fedya was caught and taken to the veterinary clinic. There, doctors removed a knife and stitched up the wound under anesthesia. Now the dog is all right, but it will take several weeks to fully recover.

    – The chef fully admitted his guilt. He said that he did not have an evil wash. Now, on this occasion, a check is being carried out, – noted the press service of the Internal Affairs Directorate for Sochi.

The reaffirmation by the Polish Constitutional Court of the preeminence of the Polish Constitution over the European treaties has provoked loud cries. European Commission, media won over to the European federalist project and some governments are screaming in unison at treason. Thus, the French government, through the voice of Clément Beaune, Secretary of State for European Affairs, has done the same. Instead of supporting Poland in its standoff with the European Union, France is sacrificing the sovereignty of the French people.
The CJEU thus declared national security laws which required telephone operators to keep the traffic and location data of their users contrary to European law. It is only when the Member State faces a “serious threat … which is present or foreseeable” that it is possible to ask operators to keep this data.

Last April, the French government was moved by this intrusion of the CJEU in the field of national security and had argued before the Council of State that the CJEU had exceeded its powers and that therefore, its decision should not not be applied.

The Council of State, accepting the government’s argument, had, by a judgment rendered on April 21, 2021, informed the same CJEU that the French Constitution remained at the top of the internal legal order and that the government retained the possibility of rule out the application of a European standard if this standard empties a constitutional requirement of its substance.

However, today, in the face of the Polish affair, this same government is contradicting itself and changing its position on a very fundamental question. The Macron State finds it more important to stigmatize Poland than to defend the sovereignty of this country … and ours in turn!

Poland is not the only member state to be concerned about this drift. The German constitutional court has developed the “ultra vires” doctrine by which it grants itself the possibility of controlling the European institutions so that they do not overstep the competences that the member states have granted them.

If the Macron State really defended the French nation, it would clearly signal to the Commission and the CJEU that their permanent encroachment on the sovereignty of the member states obliges France to agree with Poland!
More broadly, this crisis shows that clarification is needed. The French must understand that in the current state of legal relations between France and the European institutions, any attempt to end family reunification for immigrants, or any attempt to systematically expel foreign delinquents would be censured by a court. supreme European.

If the next President of the Republic truly wants to control migratory flows instead of undergoing them, he will therefore have to pass such reforms by referendum. In other words, he will have to avail himself of the voice of the people who will have expressed themselves on the subject.

But the mother of all reforms, the one that would allow France to become a democracy again, that is to say a country governed according to the principle defined in Article 2 of the Constitution (the government of the people, by the people and for the people), would be to modify article 55 of the Constitution, so that treaties no longer have an authority superior to that of laws, but simply “force of law”.

To avoid any risk of haphazard interpretation by the Constitutional Council, Article 88-1 of the Constitution, which relates to the EU, should also begin with its simple words: “Without prejudice to Article 55 …” so that ‘It is clear that the European treaties are no exception to the general rule.

This constitutional revision would give the people a voice and Parliament its role. It would not imply that France would cease to respect European treaties, but it would allow France to do so when it deems it necessary.

To do so would not fail to give rise to a conflict with the European Union, but this conflict would no longer be settled by judges but by the elected representatives of the people. France could thus, in matters of migration, take advantage of the imperative mandate given by the sovereign people following the referendum, to renegotiate the treaties and introduce an “opt-out” clause similar to that enjoyed by the United Kingdom (before the Brexit) and from which Denmark and Ireland still benefit without these countries having put themselves outside the EU.

Finally, as an additional advantage, the Commission would not be able to engage with France in the financial blackmail it exercises over Poland or Hungary. With France being a “net contributor” to the EU budget, the Commission would have little interest in cutting its payments to France, forcing France to suspend its payments to the EU. In this regard, France would be better off financially.

  7. Part 1

France’s solidarity with the Commission in this Polish affair raises the question of the sovereignty of the French people. The stakes are high. Article 55 of the French Constitution specifies that treaties have, upon ratification, “authority superior to the law”. But nothing indicates that the aforesaid treaties have authority over the Constitution … And article 5 of this same Constitution provides that the President of the Republic “sees to the respect of the Constitution” and that he “is the guarantor of independence. national ”
If the European institutions, supported by the government of Mr. Macron, imposed their vision of law, that would mean that any European directive would take precedence over the Constitution! It would also mean that the European states would have given up their sovereignty.
    A revolution from above
However, no referendum has been proposed to the French asking them to merge into a European federation. This is a genuine legal coup d’etat which removes national sovereignties with the stroke of a pen. For the French government to engage in such a maneuver is a revolutionary operation, a revolution from above.

The Macron State finds it more important to stigmatize Poland than to defend the sovereignty of this country … and ours in turn!
To understand the origin of the problem, we must recall the classic interactions between national law and international law. When two countries sign a treaty, both promise to honor it. But at any time, each signatory country can denounce the treaty or ask to renegotiate it. It can therefore be said that the international legal order ignores national law. Conversely, the place of a treaty in the national legal order depends exclusively on what the Constitution provides. In so-called dualist countries like the United States and the United Kingdom, a law is needed to transpose a treaty into national law, and a subsequent law can therefore unilaterally modify the scope of a treaty into domestic law. In monist countries, like France, the treaty once ratified becomes part of the national legal order.

Until the 1960s, treaties were a matter of foreign policy, and national courts would never dream of setting aside a law passed by Parliament because it conflicted with a treaty. Since then, two powerful trends have changed the game:

    an international legal inflation on the one hand, with in particular increasingly detailed European treaties and an explosion of secondary law (European regulations and directives), have rightly been said that the law applicable in France is now drawn up in Brussels rather than in Paris;
on the other hand, the establishment of a judicial system aimed at ensuring compliance with international standards in the domestic order.
This judicial system is made up of the Court of Justice of the EU (CJEU) which ensures the application of Union law by the member states, of the European Court of Human Rights (ECHR) which verifies the respect for the European Convention on Human Rights and national supreme courts (Constitutional Council, Council of State and Court of Cassation). Based on Article 55 of the Constitution (treaties take precedence over law), all institutions that say the law systematically censor French laws when they appear incompatible with European and international standards.

The episode of the French telephone data collection in the fight against terrorism
Use shows that the magistrates of these jurisdictions give these standards a militant interpretation. Thus, in the name of the right to a normal family life, the ECHR has ruled that migrants have the right to family reunification, which none of the drafters of the convention imagined.

Likewise, Article 4 of the Treaty on European Union may well stipulate that the Union respects the “national identity” (of the Member States), does not interfere with “functions which allow a Member State” to ‘to ensure its territorial integrity, to maintain public order and to safeguard national security ”, and that“ national security remains the sole responsibility of each member state ”, the CJEU now considers that it has a right of oversight over the national security of member states. ..
