The German government is attempting to take another step that will bring it that much closer to achieving the full totalitarian state. And all because of COVID-19 — when a pandemic is underway, citizens must give up even their most fundamental rights.

According to the German constitution, physical integrity is a fundamental right of all people. In Germany it is part of the Basic Law (Article 2.2). Both the physical and mental health of a person is considered to be part of physical integrity. Social well-being is not included.

But with this new law that has been proposed… will there be a return to the “good old days” of Dolfi, the unsuccessful painter from Braunau in Austria and his merry band of murderous sycophants? If you remember from your history lessons in school, they had those special “health care” facilities in which the “patients” wore those striped pyjamas, and they took really good “care” of them, all the way into the mass grave.

I know, since one of my grandfather’s older brothers had been taken by the authorities to one of those homes for the mentally challenged, and miraculously died within six months of pneumonia, in JULY. My great-grandparents never received his body for burial.

So my question still stands: With this newly proposed “law”, will they shoot you if you don’t comply?

Infection Protection Act as self-authorization — Greetings from Orwell!

Alice Weidel: The corona policy of the federal and state governments abuses the Infection Protection Act as a substitute emergency law in order to restrict citizens’ basic rights and freedoms and to circumvent the rights of parliamentary participation. Well-known constitutional lawyers criticize this emphatically and clearly; courts recently overturned a number of inadequately justified blanket measures.

The governing coalition is responding with a maneuver that is hard to beat in audacity: It wants to expand the Infection Protection Act to include detailed and comprehensive authorizations to act.

This is not only intended to formally legitimize the already enacted restrictions and others on fundamental rights that are probably still in the drawer, including their insatiable thirst for surveillance.

Any right to debate or even to take legal action would also be nipped in the bud. The surveillance state is within reach.

The “Draft of a Third Law for the Protection of the Population in an Epidemic Situation of National Impact” presented by the Union [CDU and CSU] and the SPD, which was on the agenda today in the plenum of the German Bundestag, reads as if it were taken directly from George Orwell’s 1984. In particular, the newly-inserted paragraph 28a of the Infection Protection Act provides for hard and unacceptable restrictions on a whole series of central fundamental rights.

Distance requirements and mask requirements, exit and contact restrictions in private and public spaces, prohibition or restriction of leisure, sport and cultural events, compulsory closings, trade bans and travel restrictions constrain, among other things, the fundamental rights of the person (Article 2 paragraph 2 sentence 2 GG), freedom of assembly (Article 8 GG), freedom of movement (Article 11 paragraph 1 GG) and the inviolability of the home (Article 13 paragraph 1 GG).

Competencies for querying and storing data will be expanded dramatically in a central electronic register from January 1, 2021, and ultimately they may be expanded to include all possible new viruses or bacteria. Even the appearance of mere symptoms should be reported.

Under the pretext of fighting a pandemic, the surveillance state creates the transparent person — from constant knowledge of the whereabouts and the forced detention of the citizens, to compulsory examinations up to the restriction of the basic right to physical integrity (Article 2 paragraph 2 sentence 1 GG) — that, too, is available.

This extension of the Infection Protection Act is de facto equivalent to an authorization that is reminiscent of dark times. It is all the more frightening that there has been no audible outcry either from the media or from society.

The AfD parliamentary group not only opposes the unabashed instrumentalisation of the Infection Protection Act with speeches and motions, it will also exhaust all means under the rule of law. The application submitted by the AfD parliamentary group to the Federal Constitutional Court for an abstract review of norms was only the first step.

  1. So “1984”, I mean “1948” was supposed to be the mile marker that told us how far it was to the Gulag that we were on t he road to. Reading your article about what Germany is trying to get away with and what is going on in America it would seem that 1984is the next turn off on the highway to Har Megiddo.

      Boris Johnson already got away with something Stalin couldn’t even do months ago. The U.K. isnt in GoV’s crosshairs anywhere near the level pf Germany is thanks to Brexit and the Refugee crisis, but it was clear from the moment gatherings of two or more people were banned and then non-cohabiting couples were banned from having sex.

        • Thats fair, what I meant was anyways was more akin to the U.K. being less in the purview of the blog’s subject, the Eurabia project and migration into the European Union in general, due to being disconnected from the European project and migrant waves by brexit and such rather than bias, perhaps I should have phrased it better.

        • It is communism by whatever Marxist form they call it these days, not national socialism in any form, I really wish people would get their damn history and terms correct. I am not defending the bloody naxis, merely trying to get you people to use correct terms for the bloody commi left throw out the naxi term anyway they can in order to silence you.           • Sir – I suggest that you do a little more research on the split in communism that happened in the first decade of the 20th century. Marian historical inevitability had been shown to be wrong, the workers revolution in the advanced capitalist countries had not happened.

            So Marxists parted ways with Gentilli moving towards Statism and Fascism (still Socialism) and Leninists looking for a revolution (1905) in Russia an undevdevelopped country both deviations for pure Marxian dogma.

            Communism, Nazism and Fascism have the same roots in Marxism and are kissing cousins. What we have in the USA has its roots in Gentilli and Sorel Statism, not in Leninism.

Well when every country around us is doing the same thing sometimes earlier and often worse the Third Reich isn’t what springs to my mind, more the universal order envisioned by its enemies, namely the United Nations born in that declaration on January 1 1942 and formalized three years later by the U.N. charter. The German government just follows the lead of its Anglo-Saxon masters that it is supposedly at odds with, just like Hungary did yesterday when it went into lockdown, and Portugal several days before that.
